On December 9, France’s Constitutional Council rejected public country-by-country reporting as it violated the freedom of enterprise guaranteed under the French Constitution.

On November 8, 2016, France published the transparency and anti-corruption bill (Law No. 830). It included the bill that proposed adoption of public country-by-country (CbC) reporting with a requirement for companies with turnover of at least €750 million to prepare an annual public CbC report starting from 2008. The €750 million threshold would decrease to €500 million and €250 million within two years and four years.

Against the Constitution

The minister of economy and finance in France, Michel Sapin, said that he warned the parliament that making country-by-country reports public could face constitutional challenges. The main reason is that the information provided in the reports contain sensitive information and could reveal important elements of companies' commercial strategy.
